Welcome to Listmyshop! These Terms and Conditions ("Terms") govern your use of the Listmyshop e-commerce platform, website, and associated services (collectively, the "Service"). The Service is provided by Cyberbix Technologies ("we," "us," or "our").
By registering for or using the Service, you ("you," "your," or "User") agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. User Accounts
Registration: To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Responsibility: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Eligibility: You must be at least 18 years of age to use the Service.
2. Subscription, Billing, and Payments
Subscription Plans: The Service is offered on a subscription basis. You agree to pay the fees for the subscription plan you select.
Advance Payment Required: All subscription fees are due and must be paid in advance of the respective service period (e.g., monthly, annually).
Billing: You authorize us to charge your selected payment method for all applicable fees. Fees are non-refundable except as required by law.
Late Payments and Deactivation: Failure to make a timely advance payment for your subscription will result in consequences. If your subscription fee is not paid by the due date, your online store will be suspended and deactivated on the very next day. Access to your store and its backend will be disabled.
Data Deletion on Non-Payment: If your subscription fee remains unpaid for a continuous period of one (1) month from the original due date, we reserve the right to permanently and irrevocably delete your store and all of its associated data, including products, customer information, and order history, from our servers. This action cannot be reversed, and we will not be liable for any loss of data.
3. Acceptable Use
You agree not to use the Service to:
Sell any products or services that are illegal, fraudulent, or violate any applicable laws or regulations.
Infringe upon the intellectual property rights of others.
Upload or transmit any material that is malicious, such as viruses or malware.
Engage in spamming or any other form of unsolicited marketing.
You are solely responsible for all content, products, and services offered through your store, as well as for your own customers.
4. Our Rights and Intellectual Property
The Service, including its software, code (Laravel 11), branding ("Listmyshop"), trademarks, themes, and overall look and feel, is the exclusive property of Cyberbix Technologies.
You retain all ownership rights to the content you upload to your store (e.g., your product images, descriptions, and customer data). However, you grant us a worldwide, royalty-free license to host, display, and use your content as necessary to provide and improve the Service.
5. Termination
Termination by You: You can cancel your subscription and terminate your account at any time through your account dashboard.
Termination by Us: We reserve the right to suspend or terminate your account at any time, with or without cause, including for any breach of these Terms.
Effect of Termination: Upon termination, your right to use the Service will cease immediately. If your account is terminated due to non-payment, the data deletion policy outlined in Section 2 will apply.
6. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. Cyberbix Technologies makes no warranties, express or implied, regarding the Service, including but not limited to its reliability, security, or fitness for a particular purpose.
7. Limitation of Liability
To the maximum extent permitted by law, Cyberbix Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Sharjah, UAE.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any significant changes by posting the new Terms on our website or by sending you an email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
